Whole Sale Cigarettes


What are the laws on tobacco and teenagers?
i live in Texas and i have a 15 year old daughter whom i have caught stealing cigarettes from me. i have grounded her and taken away privileges but that isn't working. she is still stealing them from me but instead of a few here and there, she is going in for the whole packs now. the question is, can i go to jail for her stealing them from me?

No, it is only illegal with criminal negligence to sell or give a cigarette or tobacco product to someone who is younger than 18.



Texas Health and Safety Code

Sec. 161.082. SALE OF CIGARETTES OR TOBACCO PRODUCTS TO PERSONS YOUNGER THAN 18 YEARS OF AGE PROHIBITED; PROOF OF AGE REQUIRED. (a) A person commits an offense if the person, with criminal negligence:

(1) sells, gives, or causes to be sold or given a cigarette or tobacco product to someone who is younger than 18 years of age; or

(2) sells, gives, or causes to be sold or given a cigarette or tobacco product to another person who intends to deliver it to someone who is younger than 18 years of age.
