Black Cherry Cigarettes


Are clove cigarettes illegal in every US state?
I heard they were banned in Utah, Nevada, and a few other states on the West Coast.

But is this a national ban?

Yes, it's a national ban. Obama happily signed HR 1256 Family Smoking Prevention and Tobacco Control Act into law in June and the ban went into effect 90 days later. The part dealing with clove cigarettes is:



"‘(A) SPECIAL RULE FOR CIGARETTES- Beginning 3 months after the date of enactment of the Family Smoking Prevention and Tobacco Control Act, a cigarette or any of its component parts (including the tobacco, filter, or paper) shall not contain, as a constituent (including a smoke constituent) or additive, an artificial or natural flavor (other than tobacco or menthol) or an herb or spice, including strawberry, grape, orange, clove, cinnamon, pineapple, vanilla, coconut, licorice, cocoa, chocolate, cherry, or coffee, that is a characterizing flavor of the tobacco product or tobacco smoke. Nothing in this subparagraph shall be construed to limit the Secretary’s authority to take action under this section or other sections of this Act applicable to menthol or any artificial or natural flavor, herb, or spice not specified in this subparagraph."

At the bottom, you will see different organizations that supported and opposed this bill. Philip Morris supported this bill. Why? Because they don't make any of the banned items. The ban only effects their competitors.



But this bill has a lot more in in than just a ban on flavored cigarette tobaccos. It allows the FDA to reduce the nicotine in tobacco to almost zero. It requires that graphic pictures and warnings be placed on the entire upper half of cigarette packs (front and back). If a tobacco company comes up with a cigarette with lower tar and nicotine, they aren't allowed to tell their customers about it. Even though this bill give the FDA the power to regulate tobacco companies, tobacco company officials are not allowed to state that fact publicly or in print. It orders a study about raising the minimum age to purchase tobacco. Puts strict regulations on advertisements of tobacco (no pictures and only black and white lettering).



Some of these things aren't in effect yet. Different things in the bill have different deadlines.
